Terms of Service

1. Acceptance of terms

These Terms are an agreement between you and NetSpace DIGITAL SPACE TECHNOLOGY & MEDIA JOINT STOCK COMPANY, referred to as “NetRace” or “we”, when you use the NetRace app and the netrace.vn website. By signing in or using NetRace, you agree to these Terms and to the Privacy Policy. If you do not agree, please stop using NetRace.

2. Definitions

In these Terms, “Organizer” means the entity that organizes a race and supplies the athlete list, results and photos to NetRace. “Athlete” means a person who has registered for a race that uses NetRace. “Race Photos” means photos taken at a race by the Organizer or its photographers and linked to a BIB number. “Account” means your NetRace account, which signs in with a phone number or email.

3. The service

NetRace provides, free of charge, a photo library where you can view, save, share, hide and report race photos carrying your BIB number; an athlete profile listing the races you joined and the official results published by the Organizer; and notifications when new photos arrive.

NetRace is not the organizer of races. Registration, competition, results, prizes and other race matters are the Organizer’s responsibility under each race’s rules.

4. Account

You sign in with a one-time code sent to the phone number or email used when you registered for a race. You promise that the information you provide is your own and accurate, and that you will not use another person’s phone number or email to view their photos. You are responsible for keeping your device and sign-in codes safe and for telling us immediately if you suspect unauthorized access.

To use NetRace you must be at least 16 years old or have the consent of a parent or guardian as required.

Where one phone number or email is shared by several athletes, for example when someone registers on behalf of others, each athlete should verify with their own contact details to receive the right photos.

5. Acceptable use

When using NetRace, you must not access or try to access other athletes’ photos and data; claim a BIB number that is not yours or give false information when requesting a race. You must not use photos to defame, harass, discriminate against or violate the rights of others, and must not use photos for commercial or advertising purposes without the Organizer’s permission. You must not remove, cover or edit the race logo or frame on a photo in order to misrepresent its source. You also must not scrape data automatically, reverse engineer, interfere with or overload the system, impersonate another person or organization, or use NetRace in violation of Vietnamese law.

We may suspend or terminate accounts that violate these rules under section 13.

6. Race Photos: ownership and use

Copyright in photos belongs to the Organizer or the photographer according to their agreement. You may use photos carrying your BIB number for personal, non-commercial purposes, such as saving to your device, printing, or posting to your personal social media. When posting, you should keep the race frame or logo, or credit the source.

Photos may show other people. When sharing, please respect their image rights; if someone asks you to remove a photo showing them, you should do so. If you appear in a photo and do not want it kept, use the Report photo function to request removal; the request will be passed to the Organizer for review.

Photos are currently provided free of charge. If a paid service is introduced later, its conditions will be clearly published before you use it.

7. Content you submit

When you submit a photo report, a race request, a profile edit or a support request, you allow NetRace and the relevant Organizer to use that content to handle your request. You promise the content is truthful and does not infringe the rights of others.

8. Results and race data

Names, BIB numbers, distances and results are displayed according to the official data provided by the Organizer. NetRace is not responsible for errors in the Organizer’s source data. To request a correction, contact the race Organizer; we will update when the Organizer confirms.

9. NetRace intellectual property

The name, logo, interface, source code and content created by NetRace belong to NetRace. You may not copy, distribute or create derivative works without our written consent.

10. Third-party services and links

NetRace may use third-party services for storage, email, messaging and push notifications, and may contain links to Organizers’ sites. We are not responsible for the content or policies of those external sites.

11. Changes and interruptions to the service

We may update, change features or suspend the service for maintenance, upgrades or reasons beyond our control. For changes that significantly affect you, we will notify you in the app in advance where possible.

12. Limitation of liability

NetRace is provided “as is” and as available. We work to tag photos to the right person but do not guarantee that every photo is recognized or tagged correctly. To the extent permitted by law, NetRace is not liable for indirect damages arising from use of, or inability to use, the service. These Terms do not exclude your rights as a consumer under the Law on Consumer Protection and other mandatory provisions of law.

13. Termination

You may stop using and delete your account at any time in the app under Settings, Delete account, or at netrace.vn/xoa-tai-khoan. We may suspend or terminate an account if you violate these Terms or the law; except in urgent cases or at the request of a competent authority, we will tell you the reason and give you a chance to respond. When an account is terminated, your data is handled under the Privacy Policy.

14. Governing law and dispute resolution

These Terms are governed by Vietnamese law. Disputes are first resolved through negotiation and mediation. If that fails, either party may bring the dispute before a competent court in Vietnam.

15. App store terms

If you download NetRace from the App Store or Google Play, these Terms are an agreement between you and NetRace, not with Apple or Google. NetRace, not Apple or Google, is responsible for the app, its support and related claims. You must also comply with the terms of the store from which you downloaded the app.

16. Changes to the Terms

We may amend these Terms. Important changes will be announced in the app at least 7 days before they take effect. Continuing to use NetRace after the effective date means you accept the new terms; if you disagree, you may delete your account.

17. Language

These Terms are made in Vietnamese and English. If the two versions differ, the Vietnamese version prevails.
